1. Agreement to Terms

By accessing or using aptixdigital.com (the "Site") or purchasing any service from Aptix Digital ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please discontinue use immediately. These Terms apply to all visitors, users, and customers, including purchasers of the Essential, Professional, and Premium plans.

2. Services & Subscription Plans

Aptix Digital provides AI-powered business automation services through three subscription tiers:

• Essential Plan ($97/month or $924/year): AI website builder, lead capture forms, basic CRM, chat widget, calendar scheduling, basic SMS/email automation, and Google Business Profile sync.
• Professional Plan ($297/month or $2,844/year): Everything in Essential, plus advanced automation workflows, conversion funnels, lead nurture sequences, reputation management, and AI Website Chat Bot.
• Premium Plan ($497/month or $4,764/year): Everything in Professional, plus AI Voice Bot, Google Local Service Ads management, priority support, and quarterly strategy calls.

Subscriptions are billed on a monthly or annual basis as selected at checkout via Stripe. Annual plans are billed upfront for the full year at a discounted rate (approximately 20% off monthly pricing). All plan features are subject to change with notice.

Aptix Digital reserves the right to modify, suspend, or discontinue any feature of its services with reasonable prior notice to active subscribers.

3. 30-Day Money-Back Guarantee

We stand behind our systems. New customers are eligible for a full refund within the first 30 days of their initial subscription purchase if they are not satisfied with the service.

• This guarantee applies only to the first billing period of the first subscription.
• It does not apply to renewals, plan upgrades, or additional purchases.
• To request a refund under this guarantee, email support@aptixdigital.com within 30 days of your original purchase date.

4. Billing & Payment

• All payments are processed securely through Stripe. By providing your payment information, you authorize us to charge your selected payment method on a recurring basis.
• Monthly subscriptions renew automatically on the same date each month. Annual subscriptions renew automatically after 12 months.
• You are responsible for keeping your billing information up to date. Failed payments may result in service suspension.
• Prices listed on our Site are in USD and are subject to change with at least 30 days' notice to active subscribers.

5. Cancellation

You may cancel your subscription at any time by submitting a request through our Cancellation Page or by emailing support@aptixdigital.com.

• To avoid being charged for the next billing cycle, cancellations must be submitted at least one (1) business day before your renewal date.
• Upon cancellation, your access continues until the end of your current paid billing period.
• Outside the initial 30-day money-back window, we do not provide prorated refunds for unused time in a billing cycle.

6. Acceptable Use

You agree to use our Site and services only for lawful purposes. You agree not to:

• Use the Site in any way that violates applicable local, national, or international laws or regulations
• Transmit unsolicited advertising or spam
• Impersonate any person or entity
• Attempt unauthorized access to any part of the Site or its systems
• Introduce malicious code, viruses, or harmful data
• Scrape or harvest data from the Site without written permission
• Interfere with or disrupt the integrity or performance of the Site

7. Intellectual Property

All content on this Site — including text, graphics, logos, images, and software — is the property of Aptix Digital or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, publicly display, or create derivative works from any of our content without prior written consent.

8. User-Submitted Content

If you submit content to our Site (e.g., form submissions, feedback, reviews), you grant Aptix Digital a non-exclusive, royalty-free, worldwide license to use and display that content in connection with our services. You represent that you own or have the right to submit such content and that it does not violate any third-party rights.

9. Disclaimers

The Site and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses. Results from using our services may vary and are not guaranteed.

10. Limitation of Liability

To the fullest extent permitted by law, Aptix Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Site or services.

Our total liability to you for any claim shall not exceed the amount you paid to Aptix Digital in the six (6) months preceding the claim.

11. Third-Party Services

Our services integrate with and may link to third-party tools (e.g., Stripe, Google, social media platforms). We are not responsible for the content, privacy practices, or reliability of any third-party services. Your use of third-party services is governed by their respective terms.

12. Termination

We reserve the right to suspend or terminate your access to the Site or services at our sole discretion — without notice — for conduct that violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the services ceases immediately.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Aptix Digital is registered, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration or in the applicable courts of that jurisdiction.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted with a revised "Last Updated" date. Your continued use of the Site following any changes constitutes your acceptance of the new Terms. We will provide at least 14 days' notice for material changes.

15. SMS & Messaging Terms

By providing your phone number to Aptix Digital, you consent to receive transactional, service-related, and marketing text messages.

• Opt-Out: Text "STOP" at any time to unsubscribe. You will receive a confirmation message, and no further messages will be sent.
• Help: Text "HELP" for assistance, or email support@aptixdigital.com.
• Frequency: Message frequency varies based on your interaction with our services.
• Carrier Liability: Carriers are not liable for delayed or undelivered messages.
• Rates: Message and data rates may apply.
